Your privacy is very important to us at PitchKount LLC (“PitchKount”, “we”, “us”). This Privacy Policy explains what happens to the information that you provide to us via our services, which may include those available via any website, software and/or application owned or operated by PitchKount (any of which may be referred to as the “Service” in this document). This Privacy Policy also describes the options that you have about the way your information is collected and used. By using the Service and providing us with your information, you agree to the terms and conditions of this Privacy Policy.

Information That We Collect

The Service may permit you to create an account, make requests, register to receive materials or information, or provide feedback to us. To fulfill these requests, we may ask you to provide personal information, including, without limitation, your name, email address, and phone number (“Personal Information”). In addition, if you elect to purchase a paid Service, we will ask you to provide payment information such as, for example, your credit card number (“Payment Information”).

As part of the Service, you may be asked to provide us with certain information pertaining to pitchers for your middle school or high school baseball teams including, without limitation, his name, date of birth, school grade, and throwing arm (“Player Information”). In addition, as part of the Services you will have the ability to provide performance information for such pitchers including, without limitation, the days the pitcher pitched in a game and the number of pitches the pitcher pitched in a game (“Performance Information”).

Personal Information, Player Information and Performance Information are collectively referred to in this Privacy Policy as “Collected Information.”

How We Use Information That We Collect

We may use Collected Information that you submit to us to provide you with access to the Service, to create an account on your behalf, to provide you with products, services or information that you request, or to otherwise respond to your inquiry.

We may use your Player Information and Performance Information to provide Services to other users. Specifically, other Users will have access to the following information for each of your pitchers: name, nickname, the last day the pitcher pitched a game, the number of pitches the pitcher threw in his or her last game and throwing arm. Similarly, you will have access to such pitcher information of other users.

We may use your Collected Information, in anonymized form and aggregated with other information, and provide such information to third parties. However, this use will in no way reveal your Personal Information to such third parties. We may also use any Collected Information that you submit, separately or in combination with pre-existing information to:

• Provide or allow our affiliates or service providers to provide you with information, products or services;
• Enforce our Terms of Use; or
• Contact you with more information about our services and those of our affiliates or others with whom we may have a business relationship.

In addition, we will use your Payment Information to process payment for any paid Services that you elect. If we are involved in a transaction such as a merger, stock purchase or sale, or sale of substantially all of our assets, your Collected Information and/or Payment Information may be transferred to the other party in the transaction. We reserve the right to disclose your Collected Information and/or Payment Information if required to do so by law or legal process or otherwise requested by any law enforcement or agency acting under color of law.

We will not use or share your Collected Information and/or Payment Information other than as described above without prior notice and an opportunity to opt-out pursuant to this Privacy Policy.

We will not sell your Collected Information and/or Payment Information to any third party other than in connection with a sale of all or a significant portion of our business.

Data Security

We have established appropriate physical, electronic and managerial procedures to safeguard and secure information we collect via the Service. We cannot enforce or control the security of devices and networks that you may use to submit information to us. We are not responsible for the disclosure or interception of your information before we receive it.

We use Secure Sockets Layer (SSL) or other applicable encryption when collecting or transferring sensitive data such as Payment Information. We only use Payment Information for processing payments and not for any other purpose.

Cookies

We may monitor and obtain your Service usage information by installing a “cookie” on your electronic device. This allows us to recognize repeat visitors to the Site, compile data and personalize your experience with the Service. Our cookies do not give us any information regarding your usage of any service other than our Service.

Choice and Opt-Out Preferences
